Along 34 organisations representing innovative companies across Europe, DOT Europe has signed a joint letter to Commissioners Henna Virkkunen and Michael McGrath urging the European Commission to reset the trajectory of the Digital Fairness Act (DFA).
While the DFA is presented as part of the Commission’s simplification agenda, the current preparatory work points in the opposite direction: towards additional layers of regulation in areas already covered by EU law. This risks creating legislative overlap, legal uncertainty, and increased compliance costs, particularly for SMEs and startups.
We are concerned by the possible introduction of prescriptive design requirements, an expanded blacklist of practices, and the extension of DSA-style obligations to all online actors, duplicating existing rules and creating a risk of divergent interpretations across Member States.
